Car Accident Law

Health & Safety Education defines accident as, “An unplanned, uncontrolled event which has led to or could have led to injury to people, damage to plant, machinery or the environment and/or some other loss.” And even if you survive one, the aftermath can be unpleasant.

Always drive according to safety rules unless you want to play road rage. Yes there are car accident laws to take care of those issues and it makes sure the guilty one gets punished. But can it undo the damages the accident caused? So it’s better to avoid them in the first place. Let me take you through some points so that you can avoid a car accident, and some of them are strongly recommended by car accident law as well:

  1. Position Yourself Properly: Always check the adjustment of driver’s seat before driving. A faulty position will reduce your response time during emergencies.
  2. Check Your Condition: Make sure you are not sick or drowsy. Also avoid driving in cases you are on alcohol or medications.
  3. Check Your Vehicle: Check your instruments, tire pressure and equipments before driving. A faulty mechanism can cause the most serious accidents.
  4. Pay Attention: Don’t get carried away by the tune your radio is playing. Always focus on the road. 5. Observe Blind Spots: Always do that while turning or parking. Position your mirrors properly reduce blind spots.
  5. Maintain Tailgate Distance: Never drive behind other vehicles closely.
  6. Avoid Risky Roads: If you are not confident about your driving skills then avoid busy or risky roads.
  7. Notice Your Surroundings: Watch out for people walking in the roads or other drivers. Also notice other objects and surroundings while making turns or changing lanes.
  8. Obey Traffic Rules: Always follow the traffic rules like maintaining traffic lights, driving in proper lanes etc. This includes carrying proper paperwork also.
  9. Service & Maintenance: Repair your vehicle as soon as you find any problems. If you think your car is breaking down more often than avoid driving that vehicle. Take the bus!

At the end I will advise you to try to maintain them all. This will not guarantee your safety, but will reduce the probability of accidents by 90%. Russell Honoree said that, “People need to be cautious because anything built by man can be destroyed by Mother Nature.” So 10% remains because in some cases you might not be responsible for your accidents. If you do face problems like that than contact a car accident attorney right after an accident. And finally, decide wisely and live well.

As a driver, it’s important to know what to do immediately after an accident with a pedestrian. By staying calm and speaking to the right parties, you can minimize your liability. Drivers should also learn the basic rules of fault, how injuries and damages will be compensated, and most importantly, how to avoid such accidents in the first place.

First Get medical and legal help. Next, contact the police, medical care providers, and auto insurance providers (the driver’s and the pedestrian’s). If you are facing possible criminal charges for the accident, such as driving under the influence, contact a criminal defense attorney for yourself if you can. When the police and your insurance agent arrive, give truthful statements to them about how the accident took place.

Federal and state regulations require that a certified truck inspector (usually a member of the reconstruction division of the state police) inspect any commercial truck and trailer involved in an accident before it is removed from the scene. This report reveals the condition of all of the important mechanical parts of the truck and trailer. These reports are not part of local police report. Instead, they must be obtained from the appropriate government agency. (To learn more about the particular government agencies to contact, read A articles Trucking Accidents Caused by Driver Error and Trucking Accidents Caused by Brake and Tire Failure.)

Driving at a reasonable speed . Drivers have a duty to drive at a reasonable, prudent speed. A person who drives at a speed that is unreasonable in light of the existing traffic, road, visibility, and weather conditions may be negligent. Even driving at the speed limit can be considered negligent if, for example, visibility is low, the weather is bad, or the circumstances warrant particular caution (driving by a school where you can expect children to be crossing, for example).

The law requires drivers to use reasonable care to avoid harming anyone encountered on the road. But what exactly does this entail? Here are some examples of specific requirements that the law has imposed. If a driver fails to meet these requirements, he or she may be found to have violated the driver duty of reasonable care.

Negligence is a legal theory that is the basis for many car accident lawsuits. If you’ve been in a car accident and have been sued or are suing the other party, there’s a good chance you’ve heard the term “negligence” kicked around. But what exactly is negligence and how do you prove it? Here’s a primer on using negligence as a basis for recovery in car accident cases.

In order to sort this all out, injured pedestrians may want to seek advice from a professional, such as the pedestrian’s own insurer or a personal injury attorney. Pedestrians should ask an attorney which auto insurer they should approach first, and from which insurer they might be able to receive additional coverage. To find a lawyer, see A Personal Injury Lawyer Directory.

Paula is suing Dan, claiming that she suffered whiplash when Dan rear-ended her car. Paula must provide evidence that the whip lash was due to being rear-ended by Dan and not due to some other accident or event. If Paula suffered whiplash the day before the collision while playing golf, she’ll have difficulty establishing that Dan’s conduct — rear-ending Paula’s car — caused her injuries.

In addition, in some states, if you were shown to have contributed to the car accident, even in a small way, you cannot collect from the other driver.

One obvious advantage to taking a case all the way to trial is the ability to appeal the decision. Settlement offers, if accepted, end the dispute entirely.

This also applies when you didn’t have insurance coverage at the time of the accident, and the other party is coming after you for damages.

In normal situations, both parties would contact their insurer after an accident occurs to provide them with details. In some cases, they must also make statements to the other party’s insurance company.

But if you were the victim in an automobile accident, you should also be thinking about whether an auto accident lawyer can help you recover money to pay your accident-related bills and compensate you for pain and suffering.
