Auto accident attorney

Statistics show a horrible fact: 1.2 million people die every year from car crashes worldwide. So that makes it around 3000 road kills every day. And it may become the fifth leading cause of death by 2030 if it goes like this way.

Global Auto Accidents Statistics

According to the Association for Safe International Road Travel, the current statistics for auto accidents are as following:

  1. 20-50 million people injured each year.
  2. Around 400,000 under 25 deaths every year.
  3. Stated as ninth leading cause of death worldwide.
  4. Around US$518 million damage cost annually.

Safety First!

Always maintain safety precautions while driving. Any negligence may lead to serious injuries of yours or others around you. So never drive without a legal driver’s license, keep your seat belts buckled and always follow the traffic rules. And If you have already failed to do so, then you need an attorney for your support. But before that, you have to know the common laws and penalties for an automobile accident.

Law for Auto Accident

If you seek legal support after an accident then you should not worry about that. If you go through proper procedures then the law will make sure you get your rights. You may seek the laws help in case you are not responsible for your accident and its aftermath. As an example, these are the key points of auto accident law in US:

  1. A driver must stop his/her vehicle immediately after an accident involving him/her.
  2. In California, drivers charged for fleeing accident site is punishable by serving up to one year of imprisonment. And a fine of US$1000-US$10000 is also charged as well.
  3. Fleeing the scene of accident is considered as a third degree felony in Texas. And it is punishable by up to 5 years of imprisonment.
  4. Causing death by reckless driving is punishable by up to 14 years.
  5. Depending on conviction, driver license can be seized for a certain time to lifetime.

Steps after an Auto Accident

To minimize penalties, you should go through the following steps after an auto accident:

  1. DO NOT Flee the scene of accident.
  2. CALL the police and let them know the situation.
  3. HELP the injured.
  4. DO NOT RUN after a hit.
  5. BE CO-Operative and help the emergency team.
  6. GET AN ATTORNEY as soon as possible if you are charged or if you want to.

Auto Accident Attorney

After an accident you may not be able to be in a mental stage to fight your case. But your attorney will collect all necessary information and evidence. And your attorney will set up a settlement to benefit both parties and lift the charges. An auto accident attorney will also make sure you are provided with medial cost and vehicle repair cost. So let your attorney do the work and relax.

Did you know that a driver curses around 32000 times in their life while operating a vehicle? Well that won’t help after an accident. So get medical care after an accident and never proceed without a professional accident attorney.

I had a really bad accident back in 2011. I was not fatally injured, but I couldnt work because of the mental distress. So my financial condition broke… and … I had nothing to do. Then my cousin suggested me to get an attorney. With my attorney, i got a structured settlement, and that backed me up financially, and helped to recover faster :)

A structured settlement saves you cash on your taxes. While the cash that you get in a personal injury settlement is usually not taxable, you do have to pay taxes on the interest and extras that you receive on the settlement money after you invest it. So people looking for some tax free money should get a structured settlement, at least that’s what I would probably do :)

Your solicitor may ask you to pay their expenses to support your case as it progresses (for example, the cost of medical evidence). These expenses are known as ‘disbursements’.

Deprivation of the benefits of married life after an accident or injury — affection, solace, comfort, companionship, society, help and assistance, and sexual relations between spouses.

The thought of going to court may be daunting, but it is important to remember that by this stage your solicitor will have prepared your case in detail and will have explained to you exactly what to expect. Then it’s just a question of waiting to hear the judgment and finding out if you have won and have been awarded what you were claiming.

In wrongful death cases, loss of society and companionship damages represent the positive benefits flowing from the love, comfort, companionship, and closeness that the plaintiff(s) (immediate family members) would have enjoyed had the decedent lived.

If you think that you have a 50% chance of winning at trial, and that a jury is likely to award you something in the vicinity of $100,000, you might want to try to settle the case for about $50,000. But keep in mind that every case is different, and that this is only an extremely rough outline of settlement valuation.

A value is placed on this loss by considering the couple’s individual life expectancies, whether the marriage was stable, how much care and companionship was bestowed upon the uninjured spouse (or vice versa), and the extent to which the benefits of married life have been lost.

There are so many different types of insurance it can be difficult to know which are truly necessary. Factors such as children, age, lifestyle, and employment benefits all come into play when determining which types of insurance are appropriate for you.

Get an injury attorney first, he will break it down for you.

Usually the uninjured spouse makes the claim and his or her financial recovery will depend on whether the injured spouse recovers any damages. In some cases, the injured person will make the claim as well.

Those large number of crashes points out how many people may need a lawyer. Only those who suffer from an accident know how hard it is! You can not escape that nightmare. But a lawyer can get you a nice structured settlement so that you can ease up a little bit and relax till you get okay.

Mandatory helmet laws for motorcycle operators and their passengers have, for the most part, proven to be an effective strategy in both increasing helmet use and reducing head injuries and fatalities in motorcycle accidents nationwide. But, while having an unmistakably positive effect on the overall safety of motorcycle riding, helmet laws have been met by resistance in the motorcycling community.

When I used to work in Denver, I was once rushing back home at one evening. My wife threw a party and I was late. But just as I started my car and pulled it out of parking (carefully) ,a delivery van hit my car. Luckily I was not hurt, but the back of my car was a disaster. The van was in the wrong lane. So I called my attorney, filed a lawsuit against the company and the settlement covered up my repair. That moment, I realized how important an attorney was.

A diminished ability to enjoy the day-to-day pleasures of life, “loss of enjoyment” is usually an item of general damages, meaning there is no precise way to place a monetary value on it.

All-terrain vehicles, commonly known as ATVs, are used across the country for work and play. Farmers and farm laborers use ATVs in order to keep track of livestock and grazing areas, inspect and maintain farmland, check and haul supplies to crops, and more. Many people also use ATVs for recreation on family farms, in off-road and mountainous areas, as well as in rural and coastal terrain.

A jury considers evidence that a harmonious relationship existed between the plaintiff and the decedent, their living arrangements, common interests and activities, and whether the decedent and plaintiff were separated for extended periods.

Factors that help determine whether an award should be made include the plaintiff’s age, health, life expectancy, occupation, talents, skill, experience, and training.

Past earnings are a factor in determining the appropriate amount of compensation for lost earning capacity, but the claim really focuses on what might have been earned were it not for the accident or injury. These damages represent the amount of money a plaintiff would have earned — from the time of the injury to the date of settlement or judgment.

An unemployed person may be permitted to recover lost wages if he or she can prove what could have been earned during the same period. Bills and expenses for medical services such as doctors, hospital stays, emergency room treatment, ambulance fees, and nursing services.

If you have been involved in a motor vehicle accident or other incident to which a law enforcement officer responded, a police report was probably generated. You are entitled to receive a copy of any such report, so it is a good idea to contact the responding law enforcement agency as soon as possible after the incident.
